The Bangladesh Bank has instructed that under the amended Bank Companies Act, other institutions within a group can still apply for loans even if one institution defaults. However, prior permission is required. The central bank clarified that loans cannot be granted to defaulting borrowers under Section 27 (3) of the Act. Yet, according to Section 5 (Gog), if the defaulting entity is not a willful defaulter and there are reasonable reasons for the default, other institutions in the group will not be considered in default. Bangladesh Bank directs to grant loans to group entities that are not willful defaulters. However, if any entity within the group is listed as a willful defaulter and an appeal is filed, loan approval cannot proceed until the matter is resolved.
