The Bangladesh Energy Regulatory Commission (BERC) has gained the authority to adjust energy prices, including gas and electricity, through public hearings following the repeal of Section 34(a) of the BERC Act, 2003, as announced by the Law Ministry. Previously, this clause allowed the government to set fuel prices via executive orders. With the amendment, any proposed increase in energy prices must now be submitted to BERC, which will conduct a public hearing and make a decision within 90 days. This change aims to ensure public participation and stakeholder input in determining fuel prices. An ordinance issued on December 1, 2022, had previously allowed for direct price adjustments in special cases without hearings, but this has been overridden by the new law. The Cabinet Division had approved this amendment on November 28, 2022.
