The interim government has repealed the controversial Quick Enhancement of Electricity and Energy Supply (Special Provision) Act 2010, 14 years after its enactment. President Md Shahabuddin promulgated an ordinance on Thursday, repealing the law criticized as a ‘black law’. The advisory council had endorsed the repeal on November 20. Contracts made under the law before its repeal will remain valid, and ongoing activities must continue as if the law had not been repealed. The government can review and take necessary actions on these activities.
Energy adviser Muhammad Fouzul Kabir Khan stated that all future projects and contracts must go through competitive bidding. The Consumers Association of Bangladesh (CAB) criticized the continuation of contracts made under the repealed law, calling for prosecution of those involved. The High Court had previously declared sections of the law unconstitutional. The Ministry of Power, Energy and Mineral Resources had suspended all related negotiations and processes in mid-August. The law, enacted during the Awami League government, faced allegations of facilitating embezzlement.
